The World's First Statistical Risk Analysis of Full Trademark Search Reports

Press Release (ePRNews.com) - STOCKHOLM, Sweden - Jan 26, 2016 - Markify is launching the world’s first statistical trademark risk analysis, which will be included in their Comprehensive search reports, used for trademark clearance work in the US and in the EU.

This risk analysis is based on more than 10,000 official cases of confusingly similar trademarks in the EU or the US. These conflicts come from OHIM decisions and from USPTO 2(d) citations and TTAB decisions.

“We want to help the the trademark professionals with their often time-consuming trademark clearance work,” says Benoit Fallenius, CEO and founder of Markify.

Each trademark search result is put into one of four groups, depending on its risk level:

Level 1 – Very high risk.

Of all conflicts in Europe or the US, 20% have these types of similarities.

This group of results typically stands for less than 1% of the total amount of results.

Level 2 – High risk.

Of all conflicts in Europe or the US, 40% have these types of similarities.

This group of results typically stands for only 5% of the total amount of results.

Level 3 – Medium risk.

Of all conflicts in Europe or the US, 25% have these types of similarities.

This group of results typically stands for 20% of the total amount of results.

Level 4 – Low risk.

Of all conflicts in Europe or the US, 15% have these types of similarities.

This group of results typically stands for 75% of the total amount of results.

“No other company has, to my knowledge, done this type of quantitative, statistical risk analysis,” says Benoit Fallenius.
